(1) In case any basis is mentioned in the contract regarding fee review, the board shall be subject to section 35 of the Act and determine the fee on that basis.
(2) If there is no basis mentioned in the agreement regarding fee review, the board shall review the fee based on the following matters under section 35 of the Act -
(a) Taxes, royalties and other amounts to be paid by the permit holder to the Government of Nepal,
(b) economic and social status of consumers and consumer price list,
(c) appropriate benefits to be derived by the permittee,
(d) Duration of Permit,
(e) Depreciation rate,
(f) Other matters.
